Terms and Conditions

Scope of Application

1. These General Terms and Conditions (hereinafter referred to as “GTC”) apply to sales contracts concluded by individuals and/or legal entities through the Chairzone GmbH online store.

2. These Terms and Conditions also apply to sales contracts concluded by means other than those specified in Section1.1(e.g., by telephone, letter, fax, email, etc.).

Prices

1. Unless otherwise expressly stated, all prices are listed in Swiss francs (CHF).

2. All prices include sales tax, processing fees, and shipping costs.

3. Chairzone GmbH reserves the right to change prices at any time.

4. In the event of any discrepancies, the prices and terms and conditions listed in the online storeat the time of the order shall apply.

Payment

Chairzone GmbH accepts the following payment methods:

  • Advance payment
  • Payment by Invoice:  When paying by invoice, the invoice must be paid within 30 days of receipt, unless a different payment term is expressly specified. The buyer can find the applicable payment terms on the invoice, which is provided exclusively in digital form (via email and as a download in the customer portal). The invoice is always sent to the email address provided by the customer immediately after the order is submitted.
    • Chairzone GmbH reserves the right to conduct credit checks on customers and is authorized to disclose customer data to third parties for this purpose.
    • Information regarding payment processing may be forwarded to the Swiss Creditreform Association.
    • In the event of late payment: The invoice amount is due no later than the calendar day specified on the invoice. The late payment interest rate is 9%. The contractor reserves the right to refuse an order until the entire outstanding amount has been paid. A fee of 15.00 CHF will be charged for the first reminder, and 20.00 CHF for each subsequent reminder. Collection will be handled by Creditreform Egeli St. Gallen AG.
    • The expenses incurred in this regard are subject to reimbursement and are based on the amount of the claim. The fees following an unsuccessful second reminder are CHF 60.00 for claims up to 50, CHF 100.00 for claims up to 150, and CHF 125.00 for claims up to 300; 190.00 up to FH 500, 260.00 up to FH 1,000, 350.00 up to FH 2,000, CHF 530.00 up to FH 4,000, CHF 900.00 up to FH 8,000, CHF 1,330.00 up to FH 16,000, CHF 2,000.00 up to FH 32,000, 2,600 to FH 50,000; for amounts of FH 50,000 or more, they amount to 5.5% of the claim.
  • Payment by credit card (Mastercard, Visa)
  • Bank Transfer via PostFinance

Retention of Title: The goods remain the property of Chairzone GmbH until full payment has been made.

Terms of Delivery

1. Forall items available from stock, the specified delivery time applies from the order date.

2. For items that arenot available, different delivery times apply as specified in the item description.

3. Delivery within Switzerland and the Principality of Liechtenstein is providedexclusively free of charge via a carrier’s van, with deliveryto the curb at the customer’s residence. For operational reasons,customers cannot pick up the items themselves.

4. The benefits and risks associated with the delivery are transferred tothe buyer, or tothe designated carrier,upon the goods leaving the warehouse.

5. In the event of a delayed delivery (due to a delivery date selected by the customer), payment on account remains due 10 days after receipt of the invoice. This also applies to items that are backordered and therefore cannot be shipped until a later date.

Warranty Terms

1. The warranty periods are as follows:

  • 5 years for products from theSitag, Dauphin, Bene, Varier, and Giroflex brands
  • 5 years(excluding gas springs) forHaworth brand products.
  • 2 years forHaworthgas springs
  • 3 years forTopstar brand products
  • 10 yearsforHAG brand products
  • Unless otherwise expressly stated, the warranty coverage constitutes a comprehensive warranty.

2. Chairzone GmbH guarantees, for the period specified at the time of purchase, that the goods possess the warranted characteristics, are free from defects that impair their value or suitability for their intended use, and comply with the prescribed performance standards and specifications.

Notices of Defects

1. All complaints regarding defects in items delivered by Chairzone GmbH will be considered only if they are submittedwithin 7 days ofreceipt of the goods, eitherverbally, in writing ;(letter, fax, email), orby phone.

2. Claims for defects arising fromnormal wear and tear orimproper handling are expressly excluded.

Privacy Policy

1. Chairzone GmbH undertakes to ensure security in accordance with current technical standards in systems, programs, etc., that it owns or over which it has control, and to ensure compliance with data protection regulations.

2. For all systems, programs, etc., thatdo not belong to Chairzone GmbH or over which it has no control (e.g., customer user IDs for the online store), compliance with technical requirements and data protection regulations is the responsibility ofthe respective owner. Chairzone GmbH also advises customers, in their own best interest, to keep all sensitive data (e.g., passwords, credit card numbers, etc.) confidential from third parties.

3. Chairzone GmbH assumes no liability of any kind for security vulnerabilities or system failures in programs or systemsprovided by third-party companies that collaborate with Chairzone GmbH or on which it depends.

4. Chairzone GmbH assumes no liability ;for security vulnerabilities, system failures, etc., caused by force majeure, failure by customers or third parties to take potential risks into account, unsuitable equipment used by customers or third parties, extreme environmental conditions, or interference or disruptions caused by customers or third parties (viruses, worms, hacking, etc.)—even if current security regulations have been complied with.

Scope of Use

1. All rights, in particular rights of use and copyrights ;to the contributions, articles, photos, etc. made available, are held exclusively by Chairzone GmbH with respect to the user.

Jurisdiction and Governing Law

1. These Terms and Conditions are governed exclusively bySwiss law and, unless otherwise provided by law, by the provisions ofthe Swiss Code of Obligations (CO).

2. The place of jurisdiction and performance for both parties is8105 Regensdorf.

Effective Date of the Terms and Conditions

1. These General Terms and Conditions (GTC) take effectimmediately.
